DISCLAIMER,WAIVER, RELEASE, DISCHARGE AND INDEMNITY

This is an important legal document containing essential terms on which the HELMETLOK is supplied, purchased and used. Please read this document prior to using the HELMETLOK. If you do not agree to the terms upon which the HELMETLOK is supplied, and you purchase and use it, please return the HELMETLOK to us prior to using it, for a full refund.

The supplier of the HELMETLOK N’Vision Creative Concepts Pty. Limited (the “Supplier”), has no control over the manner in which the HELMETLOK is used. The use of the HELMETLOK is strictly and solely at the risk of the person or persons using it. Those persons determine the suitability of the product for their intended use of it and assume complete responsibility, all risks and all liability of whatsoever kind for, in connection with or related in any way, directly or indirectly, to the HELMETLOK and its usage.

Recommendations and suggestions regarding use of the HELMETLOK that are made by the Supplier are a guide only and are no guarantee as to its performance. No representations or warranties, either express or implied, are made about the performance of the HELMETLOK or its fitness for a particular purpose.

The Supplier is not responsible nor liable for any loss or damage arising out of or related in any way to the HELMETLOK and its usage, whether for breach of warranty or otherwise and whether liability is asserted in contract, tort or by way of any other legal concept.

In consideration of the Supplier supplying the HELMETLOK and as essential terms and conditions of its supply, all purchasers and users of the HELMETLOK agree:

(a) to waive any and all rights that they may have against the Supplier for any loss, damage or injury of whatsoever kind that is suffered by any person as a result, in connection with or related in any way, directly or indirectly, to the HELMETLOK and its usage;

(b) to discharge, release, indemnify and hold harmless the Supplier from and against any and all liability whatsoever arising out of, in connection with or related in any way, directly or indirectly, to the HELMETLOK and its usage and for all risks, claims, actions, suits, demands and legal proceedings of any nature whatsoever, including legal costs on a full indemnity basis, arising directly or indirectly from the HELMETLOK and its usage; and

(c) that the waiver, discharge, release and indemnity granted herein may be pleaded as a complete bar to any claim, action, suit, demand or legal proceedings made or commenced against the Supplier directly or indirectly related to or concerning the HELMETLOK and its usage.

Recommendations for using the HELMETLOK

1. Take care when locking your helmet to the HELMETLOK

2. Do not swing the HELMETLOK while your helmet is hanging from it.

3. When using the HELMETLOK position it away from where it could be bumped.

4. If for any reason your HELMETLOK is not working, please do not use it. Please contact us and we will advise what steps are necessary to get it into working order.
